taxes related to cell tower lease

    Have been approached about leasing some of my land for a tower. What are the taxes associated with this.

    talk to ur lawyer, but should be simple matter to put some verbage in the lease such that the carrier(s) / tower company pays your property taxes or somethin.
    they approached you so....u got sumthin they want obviously...
    also make sure they don't try and screw ya, e.g you would want extra for each additional carrier or set of antennas and/or ground space down the road should someone else ever want to go on it also...

    best to talk to a lawyer with experience in such matters.

    The previous poster is wise in suggesting that you speak with a good attorney on this matter. Municipalities are looking for tax revenues from any assets with cell towers currently being looked at as a potential gold mine of undertaxed assets.

    Absent strong language in the agreement the landowner could be the one taxed for the value of the tower. In some northeastern states, the municipality PRESUMES that any tower is worth $300,000 and then requires the owner to demonstrate why this is not the case.

    It is my view that taxes for cell towers will only increase as municipalities discover that they have been undertaxing these assets. Given that the carrier is adding the tower- they should be responsible for both tangible and real property taxes.

    Some tower companies are wisely and unfairly putting this burden on the landowner who in some cases could find that after taxes they are losing money from having a tower on their property.
