If you are in the US and the relay or repeating device is not directly hooked up to your phone and your are not the actually licensee... no. You'll need the permission of the licensee.

To be more clear, do you mean that if I am not licensed to use the frequency (like the mobile operators who has the license), I will have to obtain the permission from the mobile operator ? Besides this, do I also need obtain license from FCC ? I will use the repeater to boost the signal strength to my cellphone. What do you mean by the second of the three conditions you listed in your reply -- "repeating device is not directly hooked up to your phone " ? do you mean that if the device is somehow connected to me cell phone, I'll be free to use the frequency ? Permission from the license holder, yes. A separate license from the FCC? No. To operate your device without the permission of the license holder, the device must be directly coupled to the phone and not transmit out more than three watts. It also must operate in a manner that does not interfere with all licensed transmissions.
