New Jersey NIMBY's again!

    The NIMBY's would really hate my area. The only requirements around here for a new tower or co-location are few.....get permission from the property/tower owner, file an engineering analysis of the proposed tower/co-location, request a building and electrical permit. Your site is approved automatically with required variances if any are needed. Although you may need to wait for up to 90 days to receive your permits. The public is allowed to comment during this 90 day period, then the public is informed that there is no law/ordinance to stop the tower/site from going up. But there are Local ordnances to encourage such expansions, like almost no restrictions what so ever. And this is the same for every township/city in the entire county. Yes I have checked. Also co-locations do not even need to be registered with any township, just walk in ask and ye shall receive your permits.

    I would be shocked if this flagpole gets approved. They need a use variance and a dimesional variance. Not a snowball's chance. It's becoming difficult to get something as simple as an approval for a conditional use these days.

    I wish this were the case, but I'm afraid it's not. There are a number of ways municipalities can and do block or made collocations difficult.

    One way is to re-zone the area where a tower is located. When towers go up, sometimes residents complain and the governing body responds by making the zoning map or ordinance more restrictive. In the case of rezoning an area, collocations become an "expansion of a non-coforming use" and can be blocked or delayed by the municipality.

    Municipalities can also require full Land Development/Sub-Division plans for collocations. Incredibly, some municipalities consider placing equipment in an existing compound a "sub-division". This causes delays and expenses. I've seen cases where even an upgrade to an existing cell site was subject to this ridiculous and wastefull process.

    some municipalities require conditional use or special exeption hearings for almost all new cell sites - no matter how unobtrusive a collocation on an exising structure might be - it can be blocked. A while back, a collocation on a water tank in NJ was discussed at WA. Residents were fighting it because they were afraid of "radiated water" - :loony: .

    Anyway, there are many ways to block new cell sites - whether a collocation or a new structure. Here's an example of the new ordinances many municipalities are adopting.

    Asking for a 112 ft tower in a 35 ft zoning area is going to be a tough sell anywhere. Did they honestly believe that they had a chance on this one?

    I agree this is going to be a hard sell for putting a tower up that much higher then the town allows.
    Kendall Park is a tough town on a lot of things, I went the Fire Official school with an inspector from Kendall Park.

    As for the ordinance link you provided, it could have been a lot more restrictive considering what they wrote, as I have seen some that are worst. I think Westfield NJ has a tougher one on cell towers, and Verizon customers can vouch for that, seems Cingular & Sprint got in just in time. luckily our town is mostly tower friendly.

    on a side note, I did find page 21's defenitions interesting & how they don't have a problem with adult stores, there is a huge fight in our town to get rid of the 4 we have & the 1 juice bar.

    I propose an organization that all NIMBYs can join to fight...for something else NIMBYfoa (NIMBYs For Other Actions). They can point out more important things to be done...like saving the rain forest, or the fact that someone didnt mow their lawn to the specified 1" level. Maybe then we could have coverage in these towns.

    The NIMBYs in my neck of the woods have turned down the little cell repeaters(?) that can be placed above street lamps and traffic lights because they are "unasthetically" pleasing. Im not quite sure what the cell companies are gonna do after this one.
