I don't know if anyone remembers the news of this guy suing a dry cleaners for $54 million because they lost his pants a few weeks ago. LOL! Well, this is the conclusion of that case. I have to say this is what I call the best ruling ever! The owners of Custom Cleaners did not violate the city's consumer protection law by failing to live up to Roy L. Pearson's expectations of the "Satisfaction Guaranteed" sign once displayed in the store window, District of Columbia Superior Court Judge Judith Bartnoff ruled. "A reasonable consumer would not interpret 'Satisfaction Guaranteed' to mean that a merchant is required to satisfy a customer's unreasonable demands" or to agree to demands that the merchant would have reasonable grounds for disputing, the judge wrote. Bartnoff ordered Pearson to pay the court costs of defendants Soo Chung, Jin Nam Chung and Ki Y. Chung. Pearson, an administrative law judge, originally sought $67 million from the Chungs, claiming they lost a pair of trousers from a blue and maroon suit, then tried to give him a pair a pair of charcoal gray pants that he said were not his. He arrived at the amount by adding up years of alleged law violations and almost $2 million in common law fraud claims. Bartnoff wrote, however, that Pearson failed to prove that the pants the dry cleaner tried to return were not the pants he taken in for alterations. Pearson later dropped demands for damages related to the pants and focused his claims on signs in the shop, which have since been removed. The court costs amount to just over $1,000 for photocopying, filing and similar expenses, according to the Chungs' attorney. A motion to recover the Chungs' tens of thousands of dollars in attorney fees will be considered later. Chris Manning, the Chungs' attorney, praised the ruling, which followed a two-day trial earlier this month. "Judge Bartnoff has spoken loudly in suggesting that, while consumers should be protected, abusive lawsuits like this will not be tolerated," Manning said in a statement. "Judge Bartnoff has chosen common sense and reasonableness over irrationality and unbridled venom." Pearson did not immediately respond to a call and an e-mail seeking comment. I agree totally, and not just because I'm a drycleaner. I once had a customer sue my business because they claimed we ruined their garment. We had a notarized laboratory analysis that said the garment was defective and the customer would still not drop the suit. We won in court, but were denied our countersuit for legal costs. It just goes to show, our legal system is broken & needs to be fixed when something like this gets this far & by a judge no less.
I was hoping this would be the outcome, I just wish the judge that made the suit had to give those people money. They should have countersued for some crazy reason.
I wouldn't say the legal system is broken. The ones that are broken are the ones who like to abuse the system.
I walked into my babie's cradle the other day and cut my foot. Should I sue my son because its his cradle? Or my father cause he built it? Or should I sue myself for being clumsy? These lawsuits today get more and more frivolous. Go to the store and buy a new pair of pants and save the 400.00 you paid your lawyer for that first hour to review your claim!
Yeah, but the guy who brought the claim forward was a judge. He represented himself therefore there were no legal expenses on his part. -jay
What gets me is that the drycleaners offered up to $12,000 as compensation and Pearson declined. I thought somewhere it said that his pants were actually worth $65 I would've taken that offer any day.
It just goes to show how they think they are right no matter what sometimes. I agree he needs to be dis-barred. I feel bad for the store owner, it's like harrasment.
I almost feel like driving to the drycleaning store and congratulate them - one drycleaner to another... I think that store is only about 30 miles from here, but its in downtown DC... -Jay
