Apple & AT&T being sued for lower iPhone price

Now this is getting completely out of hand, I think they should throw this out of the court. This is basically opening the door to every other cellphone manufacture to not be able to lower the cost of the phones, if she were to win. Get over it, it's part of all items we buy that go down in price after a period for sale. (granted this went down soon & was announced, but it's the same idea)

Incensed Over iPhone $200 Price Cut, Woman Sues Apple for $1M

A New York woman is so angry at Apple Inc. for lopping $200 off the price of the iPhone that she's filed a lawsuit seeking $1 million in damages.

Dongmei Li of Queens, N.Y., claimed the company violated price discrimination laws when it slashed the price of the 8-gigabyte iPhone by a third, from $599 to $399, within two months of the gadget's June debut.

Apple lowered the iPhone's price on Sept. 5 and also said it would stop selling the $499 4-gigabyte model. Hundreds of early customers who paid full price didn't expect a reduction so soon and complained.

Apple issued an apology the next day. Under its return policy, Apple refunded the $200 difference for those who bought the phone within 14 days of the reduction. And in a move to make peace with those who purchased the higher-priced phone before that period, the company offered a $100 credit at Apple stores.

According to Li's lawsuit, filed on Sept. 24 in the U.S. District Court, Eastern District of New York, the price reduction injured early purchasers like herself because they cannot resell the product for the same profit as those who bought the cell phone following the price cut.

Li purchased a 4GB iPhone for $499 and alleged that owners of the 4GB model were given less favorable terms than those who bought the 8GB model at the premium price, according to the lawsuit.

Apple spokeswoman Susan Lundgren declined to comment, citing the company's policy to not discuss pending litigation.

The lawsuit also named AT&T Inc., the exclusive carrier in the U.S. for the iPhone, and alleged the two companies' required two-year service contract for the iPhone constituted unfair business practices.

Mark Siegel, an AT&T spokesman, declined to comment, saying he had not yet seen the lawsuit.

This is ridiculous! I can't believe someone is sueing because of a price cut. I guess she wanted the iPhone to continue to be an overpriced luxury gadget? I hope the judge throws the case down the toilet in her face!

And how is she asking for $1Million in damages? Did her iPhone cost $1 million dollars? Apple should counter sue her for trying to rip off a company, filing a frivolous lawsuit, and making the court system waste time. I guess companies are not free to cut prices whenever they want to anymore? I thought everyone always liked price cuts.

I agree she should get over it because if she wanted to get an iPhone, she should've waited for the price cut before buying it. Everyone knew this was happening, just not when or how much. What she paid was just a "Nerd Tax" for getting a device early. Nobody forced her to pay that much.

That would be great if the Judge did that. I bet their fee's would be in the upper thousands for this.

I think if judges did this more often people will think twice before filing a frivolous lawsuit.

I don't think so. It is already common for persons sued to seek legal expenses. The few times someone has tried to sue my business I have always promptly filed a countersuit for my legal expenses. That way when the judge finds in my favor the countersuit is already on the table and the judge can rule on it immediately. Only once did a judge deny my request for legal expenses.

I think in CA there are guards for things like that and such suite could back fire. Man if this goes through we might see a lot more of this. All we have to look at is the every day pricess of phones. Wait may be I have a case for when I paid the full price for the Orginal moto Razr and since then the price dropped so much. I do not think this will go any where especialy since Apple has given a $100 refund credit for future apple purchases.
