Arrow my husband received a phone and found out it was stolen... can he use it?

My husband got a phone from his mom, and it was locked. It is an enV.

He tried to call verizon to activate it and they told him it was reported stolen.

Is there anyway he will ever be able to use this phone? how long will it stay on the stolen list? or is there a way to go around this? I'm just curious. I'm not much into going around stuff, mostly I'm curious as to if anyone knows how long it will stay on the stolen list.. it was pretty beat up, so it makes me wonder if the person "reported" it stolen to get a new phone....

Help?

It will stay on the "stolen" list until the person who reported it stolen calls them and tells them the phone has been recovered. Even at that, if the person reports it stolen, and had insurance on the phone thru Verizon, and got a new phone via the insurance then the phone becomes property of the insurance company, and only the insurance co. can release it from the stolen list.
