    Default Cancelling a tmoblie contract due to massive overcharges?

    Recently, Tmobileicon has massively overcharged my account (over $550 extra), and I had to call to complain. This is not the first time it has happened. Each time this happens I lose several hours of my day, explaining the situation and getting the refund approved.

    I am wondering if this, or any other reason, is valid enough to claim a breach of contract on their part, and allow me to cancel a contract without the $200 early teremination fee? I am one year in to a two year contract, so of course Tmobileicon is not going to give in willingly. Has anyone had success in early cancelations?

    what are they overcharging? Does it violate your contract? Do you have proof of prior credits? Theirs your out right there. If they chargeicon you ANYTHING other than your agreed upon contractual charges, it is a breach of contract on their part and you are allowed to break the contract with no repercussions

    Thanks. The thing is, YOU know its breach of contract and I know it is as well, but when I called T-Mobileicon they said they would chargeicon me 600 (since there are 3 plans on the contract). How do I get THEM to not charge me?
    Is there a way to do this without sueing?


    I do have a paper record of their excessive bills in the past, as well as the corrected one they sent after I complained.

    Have a lawyer friend? Have him/her shoot off a letter to them w/ copies of the bills as proof of breach of contract.

    no way in hell is that a valid excuse to cancel.. its not a fee...its a chargeicon that u occurued regardless if it was an error or not. they fixed it. tell me what happend. post it on my blog.,. beleive me i can tell u exactly what to do or what not to do...i have been there for over 3 years.. im the person u call

    Are u kidding me! hell no? man u need to check your facts.. only if there is a rate INCREASE not overages...its not a breach of contract what so ever other wise everyone that has ever gone over there min can cancel.. lol ..hilarious...

    There are certainly ways to get out of a contract to find them out use google and do some research.
