You will have to pay full retail, but other than that, you will not be penalized for upgrading. Equipment purchases at full retail price affect neither your contract date nor your subsidized equipment upgrade date.

| Upgrading phone
Just do like me, find a good deal on Ebay. I just got in today a used VX4400 someone sold me for 65 bucks. With 2 chargers, 2 batteries, and a leather case. The thing works perfectly. I love it, and i went and had it upgraded to ver 10 firmware. I couldnt have gotten a better deal.

| Upgrading phone
Yeah you cant get a new phone without you service being up i tryed it they told me i could buy a cheap used phone from them, til the plan ran up and then they would give me 100 dollar credit for a new plan so i just got a new nokia 3589i
