Just want a tally of current Sprint PCS users that want to get in on a false advertising campaign against them when its finally apparent that they aren't going to produce a lot of the services they promised us when we signed up for this vision. Also, any java experts that would be interested in collaborating on making a app for vision phones to support AOL IM?

You're skipping a very important part of the class action lawsuit, my friend. Here's how it works. You file suit against Sprint - using your OWN money to hire your OWN attorney(s). YOU pay the hourly rates and YOU pay the court filing fees. Along the way you have a hearing with a judge and you petition the judge to declare a class. If the judge DOES declare the class, you send out all sorts of information and try and find people. If the judge DOES NOT declare the class, you get to go to court all by your lonesome and the lawsuit continues, at YOUR expense. Sounds like you haven't really thought this through. Obviously if you could afford to hire an attorney for such an undertaking you could afford the $175 early termination fee and go find a provider who will give you what you want. Or you could (CAUTION: THOUGHT CURVES AHEAD) write a letter to the CEO of Sprint, with SPECIFIC complaints, and asking for SPECIFIC results (let you out of your contract, provide the service, give you a small consideration per month, etc.), WITHOUT threatening or making unfounded statements.

Good thinking Zaphodb! Of course, there are some cheaper options. Use the media - consumer affairs people, preferably @ 2 months before sweeps begin, be sure to give them an idea how many people in their market are affected. Contact your state attorney general, state consumer affairs agency or a federal agency, and try to get them on your side. Did I say "on your side"? sorry, that's a media reference

Ohhh, good one, good one... I have to add, if I was really serious about the class action, I would have never posted it on here.. it was just a blatant troll on my part to vent some steam... however, i do believe that it would be nice in a perfect world for someone to teach them a lesson about proper ethics and the such. Back to the serious part of my last post, are there any jave gurus around here that would be interested in working on a AIM application to run on our phones????

I'm not surprised, but I'm only half kidding about going to the FTC for false advertising if it comes to that.

I Think that if everybody sued Sprint in small claims courts throughout the country, Sprint, would have to make some changes. You see, if everyone filed a suit for say 2,500.00, It really is not Sprints financial best interest to argue or fight these cases in these small amounts. Once you have obtained a judgment against them and if they do not pay the judgment, obtain a writ of execution against them and have the Sherrif go to the local Sprint store and remove enough cash to satisfy the judgment, abd/or grab several phones as levied property as well to be sold for Sherrif sale usually 30 days later. Of course, it is not that simple, but you get the idea of the basics. And of course I am not providing legal advice. Should you need one, contact your local lawyer referral. They got me for 300.00. I'll pay that. They will pay the say 2,500 I sue for inconveniences and other losses. |

Except for the part where the judge says, "You didn't suffer $2,500.00 in damages, you suffered the $300 you were out plus costs." They don't usually award punitive damages in small-claims court.
