Lost phone

I lost my cellular phone and an aquaintance has offered to
sell me his. I have a feeling this might be a phone he
got from his insurance when he lost his phone and then found his
old one. If it is a phone he got from his cellular phone insurance
and was never activated, if I buy it and activate it will it be
tracked to his name, therefore getting someone in trouble?

Go to Ebay there are thousands of phones for every carrier on there every day.

I dont think they can trace it back as an insurance phone.. plus he was paying for insurance and paid a deductable to get the phone so its not like he stole it.
