Default Will AT&T be in breach of contract?

Sorry folks... I had to make a new screen name. I can't figure out my old pw. Been here since 2002. Here's my message:
I sent this news into CNN. I hope you will all be behind me in this. I know it's not EXACTLY Iphone news, but it regards the Iphone--and that is why I am posting it here. I hope the mods can make this a sticky:

Greetings:
As you may know, AT&T, upon release of the Iphone 3GS, promised MMS messaging to its Iphone customers by the end of the summer. In an official message, Joe Chandler (Executive Director of Corporate Communications) is quoted as saying:

We absolutely will offer MMS on iPhone 3G S in late summer once we complete some system upgrades that will ensure our customers have the best experience with MMS. These upgrades are unrelated to our 3G network. When MMS is ready, we will let customers know.

Regarding offering a tethering plan:

We plan to offer one but we don’t have an announcement to make at this time.

Today is August 8th, 2009. "Summer" official ends on September 21st. That gives AT&T 44 calendar days to provide this service. If they do not, legally, AT&T will be in breach of verbal contract with its customers.
As an avid member of the cell phone community, this tipster is going to make sure every forum member and customer is aware of this impending issue.
At this point, AT&T's hand will be forced to move, or it faces steep legal action.

Well, good luck on that one.

I don't think there is much that you can do about it, unfortunately. At least not in a court of law.

Bad PR for AT&T, yes.

I agree. at&t's legal has probably thought about this and if they don't they know what to do and the way out of it. They would not make a statement like this without knowing what would happen if they don't.

A person needs to be patient. We humans did not evolve in one day and we now demand everything to happen yesterday. How is it that you waited for 2 years and did not complain and only when it was heard about that the stink started. They were upfront and some people refuse to accept. The legal case is not going anywhere because there was nothing violated. Now please do not tell us about verbal and so on; I had clients that agreed verbally and shook hands on doing the deal only to find out that the next week they signed a contract with my competitor and I had no leg to stand on in the legal world. By the way even if they had an obligation they can legally defend and get away with it because services in the contract which we all agreed on are binding and takes priority over any verbal contract and those services did not include MMS they even say that they can not guarantee service even in the strongest area. I hope you are not party to this class action as this will for sure contribute to further costs that we end up paying for in the form of increased prices for the services instead of going down.

I agree 100%, like you I believe nothing was violated. From the very first announcement of OS 3.0, it was said that AT&T will deploy MMS for the iPhone by the end of Summer. I pay very little attention to iPhone news as I have no interest in it, inspite of that I saw it in writing many times, the point being it was openly discussed and put on the table honestly. Interestingly not all iPhone owners feel this to be an issue. I know only one iPhone owner outside of WA, who bought it for the right reasons (no I am not telling what the others bought it for. ), he is perfectly content to wait for it since it satisfies the reasons he bought it for & more.

To add to your post, the last thing I want is my rates to go up when I don't have much use for MMS & couldn't care less about the iPhone.

The Class Action suits only makes the lawyers rich. Verizon lost a class action suit couple years back & anyone who had Verizon on a certain plan & a certain time slot got a piece of the pie. There were 4 choices we had, none monetary & all insignificant, mine was 50 SMS/month free for 6 months.

Ok, I will get off the soap box for now.
