Default HTC Touch

I now have a razr from alltel and was wondering if I could get the htc touch without a data plan or if I'd have to buy one off of ebay

You can. Just don't be surprised should you decide to use data if you get extra charges.

That's not necessarily true, according to policy (I have family who works for Alltel) you have to put a data phone onto a data plan, even though they can put a data phone onto a non-data plan if the manager opts to do that. Don't be surprised also if they don't give you the discount since the discount really does apply to you purchasing the phone on a 2 year data contract.

It depends on if you buy it contract or not. I assumed the OP ment not on contract. If you get a 2 year contract you MUST get a Smart Choice plan. If you buy it outright full retail you don't. Sorry if I caused any confusion.
