Default Smartphone + Plan, is the plan required?

Hey everyone, I'm Tripme. Im just ending my first 2 year contract with alltel and wanted to know if you guys could answer some of my questions.

I ordered a smartphone and the smartphone plan, but I ended up changing my mind after that. I called back the next day to cancel the order and change the plan back. They let me change the plan to a normal one, but they had already sent the phone. I have already been charged for the phone. Am I allowed to keep the phone and use it on a normal plan? (HTC Touch) Alltel seems vague on the details.

I am going to call them and see if I can work something out from them. Let me know if you know anything about this.

Edit: Just FYI, I'm not trying rip Alltel off for a phone. If i have to return the phone, then it is what it is.

Sorry for the bump.

For future reference, here is what I learned from alltel:

If you upgrade or sign a new contract, you have to have the smartphone plan.

If you have a plan already and buy a phone from ebay, friend, etc, you do not have to have the smart phone plan.

Correct. If you decide to keep the phone, then you MUST be on the smartpack, and yes, the system WILL catch you if you try to get around the requirement.
